BREEDING AGREEMENT CONTAINING EARLY BOOKING AND MULTIPLE MARE DISCOUNTS:
This AGREEMENT is made by and between Jim & Shelby Tunnell hereinafter referred to as “farm” and_______________________________ hereinafter referred to as “owner”.
A. Upon Payment of $100 booking fee per mare, which is not refundable, Farm does hereby reserve for the owner ____ season’s bookings for the year 2008 to stallion ________________. The balance of $____________ for the first mare plus all unpaid mare care and expenses will be paid when the first mare is picked up or confirmed in foal, whichever occurs first . Each additional mare the balance of $____________(if booked by February 1st) for each additional mare plus all unpaid mare care and expenses will be paid when each mare is picked up or confirmed in foal, whichever occurs first.
B. In addition to the above charge for breeding, owner agrees to pay $7 per day mare care for each dry mare and $8 per day for each wet mare. Farm agrees to provide and feed mare(s) alfalfa hay/pellets and Bermuda hay. If owner provides additional supplements/grains Farm agrees to feed them once per day. Straight Bermuda or alfalfa hay can be provided at no additional charge.
C. In the event the mare(s) does not take and become in foal the Farm agrees to breed said mare(s) again without additional breeding fees if within two years of last date of breeding. Owner must pay the agreed upon daily charge for mare care.
D. In the event the mare(s) do not deliver a live foal, Farm agrees to give Owner the right to an additional service to said mare(s) or a replacement mare (at any time within two years from the last date of breeding said mare). For the purposes of this Agreement, “Live Foal” means “standing and nursing”.
E. The mare(s) are required to be checked and palpated by a licensed veterinarian and given a clean bill of health. We reserve the right to refuse service to any mare if, in our opinion, her breeding condition is not satisfactory. We highly recommend but do not require a clean culture unless the mare fails to conceive during two separate heat cycles then the mare must be cultured before covering for a third heat cycle. Farm shall try to settle mares but shall not be held liable if mare(s) fails to settle.
F. If prior to breeding of said mare(s), said stallion dies or becomes unfit for service, then this Agreement is null and void and all booking and breeding fees are to be refunded. If mare(s) have been bred but not in foal, the owner will be entitled to service of one of the other stallions owned by farm.
G. Farm agrees to use reasonable care and caution for said mare(s) while in their possession and is authorized to obtain any necessary veterinarian care as required but only after taking steps to contact owner without success. Owner agrees to pay for any such expenses.
H. During time mare(s) are in custody of Farm, Farm shall not be liable for any sickness, disease, theft, death or injury which may be suffered by the mare(s) and/or foal(s). This includes, but is not limited to, any personal injury Owner may receive while on Farm premises. Owner fully understands that Farm does not carry any outside insurance on horse(s) in their possession for breeding and/or boarding and Owner bears all risks connected with boarding and breeding of mare(s).
I. Contract shall not be assigned or transferred without the consent of the other.
J. A copy of the mare’s registration papers shall precede or accompany delivery of mare(s).
This agreement is subject to the laws of the State of Arizona.
